TERMS OF USE

Please read these Terms of Use before you enter or continue on this website.

Use of the site is agreement to what follows. If you cannot accept these terms, leave the site and do not use it.

Access to this website and to related sites operated by Trusted Equity Solutions, including TrustedEquitySolutions.com (together, the “Site”), is governed by these Terms of Use. By browsing or using the Site, you accept these terms in full. Earlier understandings between you and the Site are replaced by this document and have no further effect.

1. Ownership and limited permission.
The Site, together with all content, recordings, training, products, services, and other materials made available by the Organization or by third parties, and the appearance of all of the foregoing (the “Content”), is maintained by Trusted Equity Solutions (the “Organization”) for your personal use and information. That Content belongs to the Organization and/or its providers. It includes proprietary video, markup, scripts, images, voice and sound, artwork, photographs, documents, and text on the Site, other than material you yourself supply. If you keep these Terms of Use, the Organization gives you a limited, personal, non-exclusive, non-transferable permission that may not be sublicensed: you may open, view, and use the Site for your own purposes. Content may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed, put to public or commercial use, or downloaded unless the Organization gives express written leave. Changing the Content, or using it for another purpose, may infringe copyright and other reserved rights of the Organization and of the authors of the materials, and may give rise to damages and penalties. Software, tools, graphics, and sound files on the Site may not be circulated, altered, sent, or used publicly or commercially without the Organization’s express written permission.

2. Copyright notice.
Text, data, graphics, video, sound, and other materials on the Site are copyrighted unless a notice says otherwise, and are owned by the Organization and/or a supplier. They may be used only as these Terms of Use allow.

3. Forbidden uses; complaints about intellectual property. Use of Content is forbidden except where these Terms of Use expressly allow it. Unauthorized use may violate copyright, trademark, and other reserved rights, and may also implicate privacy and publicity law. Nothing on the Site or in this agreement grants, by implication or otherwise, a license to use proprietary matter without written consent from the Organization or the third-party owner. The Organization respects the intellectual property of others. It may, but need not, remove material or accounts that it judges, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or in breach of another party’s intellectual property or of these Terms of Use. If you believe your rights are being infringed, or that work belonging to you has been reproduced on the Site or in any Content, notify the Organization at TrustedEquitySolutions@tutamail.com. Include your name and contact details, a description of the work and of the alleged violation, relevant registration information, the URL or location of the material, and any other facts you consider material.

4. Accuracy of the Site.
The Organization takes reasonable care to keep information on the Site current. It does not warrant or represent that the Site is accurate. It assumes no liability for errors or omissions in the Site’s content.

5. Notices by email.
When you register with the Organization or the Site, you expressly agree to receive notices, announcements, agreements, disclosures, reports, documents, communications about new products or services, and other correspondence from the Organization. You agree that such notices may be sent to you by email.

6. Comments you send.
If you send comments or suggestions about the Site—including notes, text, drawings, images, designs, or programs—those submissions become and remain the Organization’s sole property. The Organization has no duty of confidence as to them. The Organization exclusively owns all rights in them, including intellectual property rights, and may use, publish, and circulate them for any commercial or other purpose without credit or payment to you.

7. Security limits.
The Organization will use commercially reasonable efforts to limit unauthorized access to data and files. No system, even one that uses passwords, is wholly closed to intrusion. You acknowledge that an unauthorized third party might access, view, copy, alter, or distribute data and files stored through the Site. Use of the Site is at your own risk.8. Privacy.
The Organization will not purposely give personally identifying information about you to third parties, except where the Organization in good faith believes disclosure is required to comply with law or to enforce these Terms of Use. Use of the Site is acceptance of the Organization’s Privacy Policy at www.TrustedEquitySolutions.com/privacy-policy. If you do not accept that policy, in whole or in part, do not use the Site.

9. Disclaimer; no-surprises doctrine; no earnings promise.
Neither the Organization nor any other party involved in creating, producing, or maintaining the Site or any content on it shall be liable under any circumstances for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of the Site. Without limiting the foregoing, all content on the Site is provided “as is,” without warranty of any kind, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. The Organization operates under a no-surprises doctrine: material terms are stated in plain language, and nothing on the Site is offered as a hidden promise, guarantee, or complete statement of every fact that may matter to your situation. If information is omitted, incomplete, or later proves insufficient, and harm results from reliance on that omission or incompleteness, the Organization makes no warranty and assumes no liability for that harm. The Organization does not warrant or represent the results of using materials on the Site, their fitness for any user’s needs, the chance that they will meet any user’s expectations, or their correctness, accuracy, reliability, or correction. The Organization likewise does not warrant or guarantee that you will earn money by using the Site or the Organization’s technology or services. You accept full responsibility for judging your own earning potential and for carrying out your own affairs. Results depend on your own products, ideas, and methods; your execution of your plan; the time you give to what is offered; and your finances, knowledge, and skill. Because those factors differ from person to person, the Organization cannot and does not warrant or guarantee your success or income. The Organization does not warrant that use of the materials will be uninterrupted or free of error, that defects will be fixed, or that the Site, the content, or materials on the Site are free of bugs, viruses, or other harmful components. You bear the cost of needed repairs or corrections. Please note that Equity is the only jurisdiction that shall be applicable regarding the Organization. Equity will not allow the exclusion of implied warranties. Some of the above exclusions may thus not apply to you.

10. Third-party systems; access; refunds.
The Organization is not responsible for performance or service problems caused by any third-party website or provider (including, for example, your internet service, Stripe payment services, your software, or updates to that software). Those problems are governed solely by the agreement between you and that provider. The Organization may decide, in its sole discretion, whether it is responsible for a malfunction or disruption. It may limit your use of the Site or the Content, or close an account, if it determines that you have broken these Terms of Use or any other rule or condition of the Organization. It may refuse access to the Site and to the Organization’s content, products, or services to anyone, in its sole discretion. The Organization may, in its sole discretion, refund the initial fee charged for use of the Site or any Content, or a pro-rata part of that fee, consistent with the Organization’s refund policy. The Organization shall refuse any refund thirty (30) days after your payment for use of the Site or any Content, whether under a customer license agreement or otherwise, regardless of the reason for disruption.

11. Cap on damages.
In no event shall the Organization be liable for special, incidental, indirect, punitive, reliance, or consequential damages, whether or not foreseeable, including loss of or damage to property, equipment, information, or data; loss of profits, revenue, or goodwill; cost of capital; cost of replacement services; or claims for service interruptions or transmission problems, caused by any defect in the Site, the Content, or related materials, by inability to use services provided under these terms, or by any other cause connected with them, on any theory of liability. This limit applies even if the Organization has been told, or is aware, that such damages are possible.

12. Your indemnity.
You agree to indemnify and hold harmless the Organization and each of its directors, officers, employees, and agents from liabilities, claims, damages, and expenses, including reasonable attorney’s fees, arising out of or relating to (i) your breach of this agreement, (ii) your violation of law or of a third party’s rights, (iii) material of any kind that you post or share on or through the Site, (iv) your use of the Site or of any service the Organization provides through the Site, and (v) your conduct on the Site or in connection with the services or with other users. The Organization may assume exclusive defense of any claim for which it is entitled to indemnity under this section. If it does, you shall give the cooperation the Organization reasonably requests.

13. Who may enforce these terms.
These Terms of Use exist for the benefit of the Organization, its subsidiaries and affiliates, and its third-party content providers and licensors. Each of them may assert and enforce these provisions directly or on its own behalf.

14. Governing law; Equity; severability.
This agreement shall be governed by and construed in accordance with the laws of Wyoming and/or Delaware, without giving effect to principles of conflicts of law. You further submit to the exclusive jurisdiction of Equity. If any provision of this agreement is unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity or enforceability of what remains.

15. Changes.
These Terms of Use may be revised by updating this posting. You are bound by those revisions and should return to this page from time to time to read the terms then in force.
